Overview

By engaging On Trend Creative Studio, you agree to the following Terms & Conditions. These terms apply to all services provided, including but not limited to social media management, content creation, photography, videography, website design, email marketing, blogs, newsletters, and strategic consulting.

All services are customized based on each client’s needs. Scope, deliverables, timelines, and pricing are finalized after discovery and outlined in a separate proposal or agreement.

Scope of Services

On Trend Creative Studio provides strategic, creative, and execution-based services tailored to each client. Because every business is different, services vary by client and may include a combination of strategy, planning, content creation, publishing, optimization, and reporting.

Specific deliverables are defined in your proposal or contract. Any work requested outside the agreed scope may require an additional fee.

Client Responsibilities

Clients agree to:

Provide timely access to accounts, assets, and information

Review and approve content within agreed timelines

Communicate changes, feedback, or concerns promptly

Participate in strategy calls and onboarding as required

Delays caused by missing information, approvals, or communication may impact timelines and performance.

Communication & Workflow

We operate using structured systems, workflows, and timelines to ensure clarity and efficiency. Clients will be onboarded into our communication and project management systems and are expected to use those systems for ongoing collaboration.

Payment Terms

All services are billed according to the agreed pricing outlined in your proposal or contract.

Monthly services are billed in advance

One-time services may require partial or full payment before work begins

Payments are non-refundable unless otherwise stated in writing

Late payments may result in paused services

Minimum commitments apply to most monthly packages.

No Guaranteed Results

While we use proven strategies, data-backed planning, and professional execution, results are influenced by many factors outside our control, including algorithms, market conditions, audience behavior, and client participation.

We do not guarantee specific outcomes such as revenue, follower growth, engagement levels, or conversions.

Limitation of Liability

On Trend Creative Studio is not liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid by the client for services rendered during the applicable period.

Termination

Either party may terminate services in accordance with the notice period outlined in the contract. All outstanding invoices must be paid before termination is finalized.

Governing Law

These Terms & Conditions are governed by the laws of the State of Georgia.

DISCLAIMER

On Trend Creative Studio does not guarantee business growth, revenue increases, platform reach, or algorithmic performance. Digital platforms frequently change policies, algorithms, and features beyond our control.

We are not responsible for:

Platform outages or changes

Account suspensions or restrictions

Third-party tools or integrations

Client failure to implement recommended strategies

All decisions made using our content or strategy remain the responsibility of the client.

CONDITIONAL GUARANTEE

Any performance-based expectations or improvements are conditional upon:

Timely client communication and approvals

Use of recommended strategies and systems

Consistent implementation of the agreed plan

Client participation in onboarding and strategy processes

Failure to meet these conditions may impact results and void any implied performance expectations.

REFUNDS & CANCELLATIONS

All payments are non-refundable once work has begun.

Monthly retainers are non-refundable and require the agreed minimum commitment. Early termination does not release the client from outstanding financial obligations.

Notice is required to cancel ongoing services, as outlined in your contract.

INTELLECTUAL PROPERTY
Ownership

Clients own the final, approved deliverables provided under their agreement, excluding proprietary systems, templates, workflows, and strategic frameworks developed by On Trend Creative Studio.

Agency Rights

On Trend Creative Studio retains the right to:

Reuse processes, systems, and methodologies

Showcase completed work for portfolio, marketing, or promotional purposes unless otherwise requested in writing

Raw Assets

Raw footage, photography, or unedited files are not included unless explicitly stated in the proposal.

Clients may not resell, redistribute, or transfer content created by On Trend Creative Studio without written permission.
